General Terms and Conditions

1. Scope and Applicable Law

These General Terms and Conditions (T&Cs) apply to all orders placed between Ionsent GmbH and the customer via all direct sales channels. Deviating conditions do not apply unless Ionsent has expressly agreed to them in writing. The law of the Republic of Austria applies to these General Terms and Conditions and any legal transactions concluded with Ionsent. The UN sales law and any other international agreements are not taken into account.

2. Conclusion of contract

The presentation of the products does not constitute a legally binding offer. Even with an order confirmation, we grant ourselves the right to withdraw from it or to be able to make an alternative offer. The order confirmation takes place immediately after the order has been sent by an automated e-mail, which does not represent a legally binding confirmation of the purchase contract. It is important to enter the actual e-mail address when placing your order so that you receive the e-mail to verify the items ordered. The purchase contract is only concluded when we send you the ordered goods.

3. Right of Withdrawal and Consequences

In the following you will receive the legally required instruction about the right of withdrawal to which you are entitled and its consequences. Since we only supply business customers or commercial customers (B2B), we exclude a right of withdrawal. We reserve the right to act as a gesture of goodwill, based on our unspecified criteria, to which there is no right to information. Furthermore, we would like to make it absolutely clear that products with an expiration date, special storage regulations or ready-made goods cannot be canceled or returned after the order has been placed.

4. Payment and Invoicing

In the case of payments on account, we expressly point out that if the customer does not pay on time, we are entitled to forward the process to a debt collection service provider for the purpose of collecting the claim there. In this case, the customer must also bear the additional costs associated with the delay.

5. Prices and shipping costs

The prices at the time of the order apply. All prices shown are net prices and do not include the statutory sales tax plus the shipping costs incurred. A list of the flat-rate shipping costs is shown separately (e.g. in the shopping cart/checkout). Ionsent reserves the right to change the published prices at any time.

6. Terms of Delivery

The delivery takes place from our warehouse or our logistics partner to the delivery address specified during the ordering process, unless otherwise agreed. In principle, we assume that we will process incoming orders within 24 hours on weekdays and then ship them. In the case of promotions, the delivery time may be delayed. The duration of our standard shipping depends on the delivery area, volume and availability. If Ionsent is not able to deliver the ordered goods through no fault of its own because Ionsent's supplier does not meet its contractual obligations, Ionsent is entitled to withdraw from the ordering party. In this case, the customer will be informed immediately that the ordered product is not available.

7. Retention of Title

The goods remain the property of Ionsent GmbH until full payment has been made.

8. Warranty

Unless expressly agreed otherwise, the statutory warranty provisions apply. The statutory limitation period for warranty claims applies from the date of purchase. Damages are excluded from the warranty in the following cases:

Defect or damage due to improper use or improper care

Defect or damage caused by fire, water or natural disasters and earthquakes

Optical changes due to natural wear and tear

9. Liability for Defects

Unless otherwise specified below, Ionsent's liability for damages is limited to grossly negligent and intentional behavior, regardless of the type of breach of duty and including tortious acts. However, this liability is limited to the amount of damage typically foreseeable at the time the contract was concluded, depending on the type of order. Any liability limitations do not apply in the event of injury to life, limb or health, in the case of promises of guarantees if agreed and in the context of cases within the scope of the Product Liability Act. Insofar as Ionsent's liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents. As part of the supplementary performance, Ionsent will only choose the replacement delivery.

10. Item Descriptions

The available product photographs and informational text represent the product as accurately as possible. Ionsent cannot be held responsible for any errors that may appear on the site and cannot guarantee that all images accurately reflect the actual appearance of the product. The photographs may vary depending on the (color) settings of your computer. All images are to be regarded as non-binding illustrations and therefore do not guarantee a correct representation of the properties. Therefore, please note the written description.

11. Severability Clause

Should individual provisions of the contract, including these regulations, be or become wholly or partially invalid, or should the contract contain an unforeseen gap, the validity of the remaining provisions or parts of such provisions shall remain unaffected. Instead of the invalid or missing provisions, the respective statutory regulations apply.
